1. Information on how to enter and prizes form part of these conditions of entry.
2. Entry is open to all residents of Australia and New Zealand who subscribe or renew their subscription between 24/03/08 and 18/05/08 to one or more of the following publications:- The Australian Women’s Weekly; Australian House and Garden; Madison; Good Health & Medicine; Australian Gourmet Traveller; Burke’s Backyard, Shop Til You Drop, Real Living, Mother & Baby, Slimming & Health, Money and Belle. Entry is subject to a valid credit card or, if payment is made by cheque, the cheque must be cleared for payment by the close date of the promotion. Subscriptions are to be sent to the above magazines (please clearly specify the name of the magazine you wish to subscribe to) at Reply Paid 4967, Sydney, NSW 2001; by phone 136 116 (Mon – Fri 8am – 8pm), via fax to (02) 9267 4363 or online at www.mothersday.magshop.com.au or www.magshop.com.au. Both the gift recipient and the donor are eligible to win. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.
3. The promotion commences 24/03/08 and closes 23:59 EST 11:59 on 18/05/08. The draw will take place at Level 11, 54 Park Street, Sydney NSW 2000 on June 16th, 2008 at 11am. Winner will be notified by mail and their name will be published on www.magshop.com.au, and in The Public notices section of The Australian on Thursday June 19th, 2008. Judges' decision is final and no correspondence will be entered into.
4. There will be 1 prize on offer to 1 individual winner. The prize is for 2 people and the prize sharer is to be selected at the discretion of the winner himself/herself. The first valid entry will win:
• Return Business Class flights to London for 2 people from the winner’s closest Australian capital city serviced by Emirates, flying with Emirates Airlines (valued up to $19,078 depending on time of year trip is taken). Both persons must travel together on the same dates & routing.
• Insight Vacations’ 20 Day Romantic European holiday (valued at $11,750). This tour includes accommodation, breakfasts, some dinners and selected city tours.
• Insight Vacations’ contribution of $5,000 spending money.
• Total prize pool is valued up to $35,828 (depending on point of departure).
• If the winner wishes to stay longer in Europe or at more salubrious accommodation – this will be at their own expense.
i. All components of the prize must be taken together. Prize is subject to tour availability and flight availability and conditions. The prize is as stated above and is not redeemable for cash, or airline points and is non transferable. The prize winner is subject to insight vacations normal booking conditions detailed in the back of the brochure and on the website.
ii. Prize is based on twin share accommodation.
iii. All other costs including meals, spending money, transport to and from departure/ arrival points, taxes, insurance, travel insurance, passports, visas, beverages, meals, optional excursions whilst on tour and all other ancillary costs are the responsibility of the winner and their travel companion. Insight Vacations’ will arrange for delivery of the prize to the prize-winner.
iv. Prize is valid for travel for 12 months from the draw date. No extension on the validity date of this prize will be permitted. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee at the cost of the winner. Embargo restrictions apply during certain periods.
v. Prices quoted are recommended retail and are correct at time of publishing and can be changed at any time subject to market fluctuation. Promoters and publishers take no responsibility for market price fluctuations.
5. Travel Insurance will be at the winner’s personal expense. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. Prize is subject to booking and availability.
6. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; and/or (f) attendance at the prize event.
7. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
8. In the event of unforeseen circumstances, the promoter reserves the right to offer an alternative prize of equal or greater value. In the event of war, terrorism, state of emergency or disaster (including natural disaster), the Promoter reserves the right to either provide an alternative travel prize (including an alternative destination as specified by the Promoter) to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion.
9. If the required information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, each entrant agrees that the Promoter may disclose entrants’ personal information to applicable State and Territory lottery departments, and that the winner's name and locality will be published as required under the relevant lottery legislation. By entering this promotion, all entrants will be deemed to have accepted these terms and conditions. If the prizewinner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter at their discretion.
10. The Promoter may conduct a further draw at the same time and place as the original draw as necessary on 11 October 2008 in order to distribute any prize which remains valid and unclaimed by that date subject to reference to all relevant state and territory regulations and any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA). Publication of unclaimed prize draw winner will be in the Public Notices section of the Australian on 17 October 2008.
11. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
12. The Promoter reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Conditions of Entry.
13. All entries become property of the Promoter the collection, use and disclosure of all personal information collected in connection with this promotion is governed by the Privacy Notice.
14. The winner (and any companion) is responsible for ensuring that they have any required travel documentation. The winner (and any companions) must depart from and return to the same point of departure and travel together. Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The winner may be required to present credit card at time of check in at accommodation.
15. By entering the promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit (with their literary piece being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant.
